New ECHR Readings and Comments

A new issue of the Human Rights quarterly, new posts on blogs and new publications on SSRN yield a number of noteworthy readings on the European Convention and the European Court. I have assembled them here.

First off, the newest issue of the Human Rights Quarterly (vol. 35, no. 4, November 2013) includes:

* Başak Çali, Anne Koch & Nicole Bruch, ‘The Legitimacy of Human Rights Courts: A Grounded Interpretivist Analysis of the European Court of Human Rights’
* Ergun Özbudun & Füsun Türkmen, ‘Impact of the ECtHR Rulings on Turkey’s Democratization: An Evaluation’

Secondly,  Francesco De Sanctis has posted a commentary on the impact of the Maktouf-Damjanović vs. Bosnia-Herzegovina  on the accountability for and punishment of war crimes in that country on EJIL Talk!

Thirdly, Paul Gragl pas posted his fortcoming article ‘A Giant Leap for European Human Rights? The Final Agreement on the European Union’s Accession to the European Convention on Human Rights’, to be published in the Common Market Law Review (forthcoming) on SSRN.

Finally, Riccardo Pavoni has put his book chapter ‘Environmental Jurisprudence of the European and Inter-American Courts of Human Rights: Comparative Insights’, to be published in B. Boer, The Environmental Dimension of Human Rights, Oxford University Press (forthcoming), on SSRN.

The latter triggers me to comment that it would be good if all publishers would allow their authors to pre-publish forthcoming book chapters on SSRN, out of considerations of open access and academic debate. Now, there is a big divergence on this still ,with Oxford University Press (the book chapter above) apparently allowing it and Cambridge University Press not, for example. Let me add here then my own voice of support to the growing chorus in and beyond academia that pushes for more open access.
